CIPLA Meeting May 16, 2019 – Ex Parte Seizures Pursuant to The Lanham Act and Recent Case Law Developments

Event Details

Maja Szumarska of Gibney, Anthony & Flaherty, LLP

The Lanham Act authorizes courts to issue ex parte orders directing the seizure of counterfeit goods. By enacting this law, Congress recognized that, absent such ex parte relief, willful counterfeiters would likely destroy or transfer counterfeit merchandise and business records upon the filing of a lawsuit.  Congress created a formal procedure for obtaining an ex parte seizure order.  Ms. Szumarska will be speaking about recent cases and provide recommendations for increasing the likelihood of successfully obtaining an ex parte seizure order and minimizing the risks of liability while executing such an order.

The meeting will be held on Thursday, May 16, 2019 at the Graduate Club in New Haven. Please RSVP by May 13, 2019 on the CIPLA website or by emailing CIPLA Program Chair Ray Zenkert at
