Our guest speaker Attorney Eleanor M. Lackman of Mitchell Silberberg & Knupp LLP will discuss the 2023 U.S. Supreme Court case Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith, which held that the famous artist Andy Warhol’s renderings of photographer Lynn Goldsmith’s photographs of music artist Prince did not qualify as transformative fair use. Of particular interest is the Supreme Court’s controversial treatment of the factor of commercial use in the fair use analysis.

About our Guest Speaker

Eleanor M. Lackman is a Partner at the law firm Mitchell Silberberg & Knupp LLP where she divides her time between the firm’s New York and Los Angeles offices. She is Co-Chair of the firm’s intellectual property practice group. Ms. Lackman is a nationally recognized lawyer for copyright, trademark, and media matters. For over 20 years, she has litigated cases in courts across the country, while counseling copyright and brand owners. In the Andy Warhol case Ms. Lackman filed an amicus brief on behalf of Sesame Workshop, Inc., Authors Guild, Inc., News Media Alliance, and other parties with an interest in the case.
